The franchisor protects each franchised outlet with a delineation of territory. This area is negotiated on a site by site basis and franchisees are granted exclusive rights to a territory in which to operate their franchise. In terms of this clause the franchisor shall not be entitled to appoint another franchised outlet within the agreed radius (generally 5km) of the premises, without offering the franchisee the right of first refusal in relation to such proposed franchise. |
